1. Our Mission

Before using the Website, it is important that you thoroughly review the Terms of Use. By accessing the Website or selecting the option to accept or agree to the Terms of Use (if available), you are acknowledging and accepting that you are bound by these Terms of Use and our Privacy Policy, which is included in this document. If you do not wish to accept these Terms of Use, which includes the referenced agreements, you must refrain from accessing or utilizing the Website.

2. Definitions

In this document, we use the following terms

  • Host: A registered user of the Big Nomads platform who has the legal right to offer a specified property for rental and creates a Listing on the Big Nomads platform for that property.
  • Guest: A registered user of the Big Nomads platform who makes a Booking to rent a property listed by a Host.
  • Booking: The agreement between a Guest and Host for the rental of a specified property for a specified period, as facilitated through the Big Nomads platform.
  • Listing: The description, details, pricing, and availability for a specific property that a Host is offering for rental on the Big Nomads platform.
  • Platform: The Big Nomads digital service, including its website and any associated apps, through which Guests can browse and book Listings, and Hosts can create and manage Listings.
  • User: Any individual who has registered an account with the Big Nomads platform, including but not limited to Guests and Hosts.
  • Content: Any text, graphics, images, music, software, audio, video, information, or other materials that are posted, generated, provided, or otherwise made available through the Big Nomads Platform.

3. Our Platform

3.1 Our role

The Big Nomads Platform offers you the right to use a digital service that enables Users to publish, offer, search for, and book Listings. When Users make or accept a Booking, they are entering into a contract directly with each other. Big Nomads is not and does not become a party to or other participant in any contractual relationship between Users. We reserve the right to review, modify, and delete Content for the following purposes:

  • Improving the Platform
  • Ensuring Listings adhere to our eligibility criteria and maintain a level of quality
  • Ensuring our Users comply with these Terms
  • Addressing harmful User Content
  • Complying with applicable laws and regulations, requirements of a court, or other administrative agency or governmental body

3.2 Accuracy

While we take reasonable care to ensure that every piece of information on the Big Nomads Platform is accurate, we cannot guarantee that all information will remain accurate over time. We encourage our Users to notify us of any discrepancies they encounter. To the extent permitted by law, Big Nomads cannot be held responsible for any errors, interruptions, or missing information, although we will do everything we can to correct or fix them as promptly as possible.

3.3 Eligibility

You must be at least 18 years of age to use the Big Nomads Platform. To make a Booking or to create a Listing, a User must create an account in accordance with our registration process. By using the Big Nomads Platform, you represent and warrant that you meet all the eligibility requirements contained in these Terms.

4. Guests

4.1 Searching

Users of the Big Nomads Platform (“Platform”) may conduct searches for Listings by specifying the desired destination, duration of stay, and other relevant criteria, and may utilize various filters to refine search results. Search results may be sorted based on factors including, but not limited to, internet connectivity, number of bedrooms, price range, and other relevant criteria.

4.2 Booking

Upon selecting and booking a Listing, the Guest undertakes to remit all applicable charges relating to said Booking. Confirmation of the Booking by the Host constitutes a legally binding agreement (“Reservation”) between the Guest and Host. The Guest is obligated to adhere to all conditions stipulated in the Reservation, including the cancellation policy and any rules specified by the Host in the Listing. Payment obligations shall be fulfilled through the payment processor Woocommerce, and the Guest must accede to the terms stipulated by the Host. Accessibility requests may be directed to the Host, but the Platform does not warrant that such requests can be accommodated. 

4.3 Reservation

A Reservation grants the Guest a limited, revocable license to enter, occupy, and utilize the Accommodation. The Host retains the right to re-enter the Accommodation during the Guest’s stay to the extent it is reasonably necessary, permitted under the contract with the Guest, and in compliance with applicable law. Failure to vacate by the designated checkout time may result in lawful removal and imposition of overstay penalties. Occupancy shall not exceed the maximum number of permitted Guests.

4.4 Cancellations

Cancellation of a Reservation may entitle the Guest to a refund in accordance with the agreed-upon cancellation policy, as delineated in the Reservation. Read our cancellation policy for further details.

4.5 Booking Modifications

Modifications to a Booking must be mutually agreed upon by both the Guest and Host. Such modifications may incur additional charges, fees, or taxes, for which the Guest is responsible.

4.6 Guest Responsibilities

Guests are accountable for their own acts and omissions, as well as those of any individuals they invite or provide access to the Accommodation. This includes responsibility for maintaining the Accommodation in the condition it was found, remitting payment for any damages caused, and adherence to all applicable laws and standards of decency. If booking on behalf of a minor or permitting a minor’s access to a Host Service, the booking party must possess the legal authority to act on the minor’s behalf and assumes full responsibility for their supervision.

5. Hosts

5.1 Managing Listings

Hosts must create and manage Listings in accordance with our Listings Policy, taking care to represent each Accommodation accurately. Misrepresentation of any facet of the Accommodation to an unreasonable extent may result in penalties, including but not limited to removal of the Listing or suspension of the Host’s account.

5.2 Your Legal Obligations

Hosts must familiarize themselves with and adhere to the legal obligations applicable to their jurisdiction. In cases where the Host operates a hotel or similar establishment, it is incumbent upon the Host to secure any necessary permits, licenses, or comply with local regulations governing hotels and short-term rentals. Failure to comply may lead to legal actions or other penalties.

5.3 Entering Into A Contract

By accepting a Booking from a Guest, the Host enters into a contractual relationship with the Guest, committing to deliver the Accommodation at the price and terms specified in the Listing. The Host also agrees to remit any applicable commission to Big Nomads and to comply with all tax obligations and payment processing fees as required by local law and payment processors, including WooCommerce.

5.4 Cancellations & Modifications

Cancellations are governed by our cancellation policy, and Hosts may detail their individual cancellation policies within the Listing. Valid reasons for cancellation may include, but are not limited to, unforeseen damage to the property, serious illness, compliance with legal obligations, etc. Canceling without a valid reason may result in a cancellation fee and/or account suspension. Modifications to Bookings must be coordinated directly with the Guest.

5.5 Issuing Refunds

Refunds shall be dictated by the Host’s policy and facilitated through WooCommerce. Big Nomads will not act as an intermediary or bear any responsibility for the issuance or amount of refunds.

5.6 Responsibilities

The relationship between Hosts and Big Nomads is that of independent parties. Hosts are obligated to adhere to the Listing Policy, provide accurate information regarding their Listings, and not encourage Guests to conduct transactions or communications outside of the Big Nomads Platform.

5.7 Independence

The relationship between Hosts and Big Nomads is one of independence and does not constitute a partnership, employment, agency, or joint venture. Big Nomads does not exert control or direction over the Listings, and Hosts retain full discretion regarding the provision of Listings and Bookings, including pricing and terms.

5.8 Taxes

Hosts are solely responsible for fulfilling their tax obligations in accordance with applicable law. Tax-related information is made available via WooCommerce, enabling Hosts to manage their tax matters effectively. Hosts should consult with qualified tax professionals to ensure compliance.

6 Accounts

6.1 Account Creation

In order to access the majority of the features provided by the Big Nomads Platform, including but not limited to making Bookings as a Guest or creating Listings as a Host, Users must register an account with Big Nomads. Users must be at least 18 years of age to create an account.

6.2 Account Accuracy

Users must provide accurate, current, and complete information during the registration process and maintain the accuracy of such information throughout the tenure of the account. It is prohibited to register more than one account per individual or to transfer an account to another person. Misrepresentation or omission of information may lead to penalties, including the termination of the account.

6.3 Account Termination

Big Nomads reserves the unilateral right to delete or suspend a User’s account, without prior notice or liability, should the User violate these terms or any other agreement with Big Nomads, or for any other reason deemed justifiable by Big Nomads in its sole discretion.

6.4 Confidentiality and Security

Users are solely responsible for maintaining the confidentiality and security of their account credentials. Disclosure of credentials to any third party is strictly prohibited, and Users are liable for all activities conducted through their accounts. Any suspicion of unauthorized access, loss, theft, or compromise of credentials must be reported immediately to Big Nomads.

6.5 Verification

To the extent permitted by applicable law, Big Nomads may, but is not obligated to, request identification or other information for the purpose of verifying a User’s identity or background. Such verification processes may include checks designed to verify the User’s identity or background and may be conducted at any time during the User’s relationship with Big Nomads.

7 Platform Rules

7.1 General Rules

The following rules apply to all Users of the Big Nomads Platform:

Prohibited Actions: Users shall not scrape, hack, reverse engineer, compromise, impair, or use bots, crawlers, scrapers, or other automated means to access, collect data or other Content, or interact with the Platform.

Security Measures: Users shall not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Platform or Content.

Unauthorized Use: Users shall not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the Platform.

Use of the Platform: Users must only use the Platform as authorized by these Terms or another agreement with Big Nomads.

Personal Information: Users may only use another User’s personal information as necessary to facilitate a transaction using the Platform as authorized by these Terms and must comply with privacy, data protection, and export laws.

Unauthorized Commercial Messages: Users must not use the Platform, messaging tools, or Users’ personal information to send commercial messages without express consent.

Content Use: Content made available through the Platform may only be used as necessary to enable use of the Platform as a Guest or Host, and not without permission from the Content owner or authorization by these Terms.

Avoiding Fees or Taxes: Users shall not request, make or accept a Booking or payment outside of the Platform to avoid paying fees, taxes, or for any other reason.

Third-Party Interaction: Users must not require or encourage Guests to interact with third-party websites, applications, or services without authorization by Big Nomads.

Manipulating Search Algorithm: Users shall not engage in practices intended to manipulate Big Nomads’ search algorithm.

False Bookings: Users must not book a Listing unless they intend to use the Listing.

Unauthorized Display: Users must not use, copy, display, mirror, or frame the Platform, Content, branding, or any page layout without Big Nomads’ consent.

Damaging Actions: Users must not take any action that could damage or adversely affect the performance or proper functioning of the Platform.

Legal Obligations: Users must honor legal obligations, including compliance with applicable law and obtaining necessary authorizations for processing personal information under Big Nomads’ Privacy Policy.

7.2 Content

Parts of the Big Nomads Platform enable Users to provide Content. By providing Content, Users grant Big Nomads a non-exclusive, worldwide, royalty-free, sub-licensable, and transferable license to utilize such Content for the Platform’s promotion and purposes. If Content includes personal information, it must comply with applicable data protection laws. Big Nomads may own Content where it has paid for or facilitated its creation. Users are responsible for all Content provided, including any violations of intellectual property or privacy rights, and must comply with Big Nomads’ Content and Nondiscrimination Policies. Translations of Content may be provided, but Big Nomads does not guarantee their accuracy.

7.3 Reviews

After each Booking, Guests and Hosts may review each other. Reviews must be accurate and comply with Big Nomads’ Content and Review Policies. Big Nomads does not verify the accuracy of Reviews immediately, however, if any aspect of a review is called into question, we will take measures to verify the claims made in this review.

7.4 Intellectual Property

Big Nomads respects the intellectual property rights of others and expects Users to do the same. Users must not infringe upon the copyrights, trademarks, or other intellectual property rights of any third party. Any unauthorized use of the intellectual property of Big Nomads or third parties may result in termination of the User’s account and legal action as applicable under the law. Users who believe their intellectual property rights have been infringed may contact Big Nomads to report the alleged infringement.

8 Reporting

If you believe that a Member, Listing, or Content poses an imminent risk of harm to a person or property, it is your responsibility to immediately contact local authorities before contacting Big Nomads. Furthermore, if you believe that a Host, Member, Listing, or Content has violated our Standards, you should report your concerns to Big Nomads. If you have reported an issue to local authorities, Big Nomads may request a copy of that report. Except as required by law, Big Nomads is not obligated to take action in response to any report. This serves to prioritize the urgency of immediate risks and allows Big Nomads to gather necessary information while preserving the autonomy and safety of the Platform.

9 Resolution

Conflicts and disputes must be handled according to our Nomad Protection Policy. To seek resolution, you must engage with our support system and attempt to resolve the issue with our team. Big Nomads makes considerable effort to provide fair resolution and expects all Users to cooperate fully with the resolution process. Failure to adhere to the Resolution process as dictated by our Nomad Protection Policy may result in limited access to the Platform or other consequences.

9.1 Arbitration

Any disputes, controversies, or claims arising out of or relating to these Terms, the Platform, or the relationship between a User and Big Nomads, that cannot be resolved through our Resolution process, shall be settled by binding arbitration administered in Canada, in accordance with Canadian arbitration law. The arbitration shall be conducted by a single arbitrator, and the language of the arbitration shall be English.

The decision of the arbitrator shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction. Both parties waive their right to a trial by jury or to participate in a class action lawsuit.

The User is responsible for all administrative and arbitration fees, except where prohibited by Canadian law. If the arbitrator finds in favor of the User, Big Nomads will reimburse the User for all fees related to the arbitration paid by the User.

Nothing in this section shall prevent Big Nomads from seeking injunctive or other equitable relief from the courts for matters related to intellectual property rights or unauthorized access to the Platform.

This Arbitration clause shall survive the termination or expiration of these Terms.

10 Termination

10.1 Term and Continuation

The agreement between you and Big Nomads reflected by these Terms remains in effect until terminated by either party in accordance with these Terms. This ensures a continued relationship governed by the principles and guidelines set forth in this agreement.

10.2 Termination Rights

You may terminate this agreement at any time by sending us an email or by deleting your account. Big Nomads may terminate this agreement for any reason by providing you with 30 days’ notice via email or other contact information you have provided for your account. Additionally, Big Nomads may terminate this agreement immediately and without prior notice, stopping access to the Platform if:

  • You materially breach these Terms, Additional Legal Terms, or our Policies.
  • You violate applicable laws.
  • Such action is necessary to protect the personal safety or property of Big Nomads, its Members, or third parties (e.g., in the case of fraudulent behavior of a Member).
  • Your account has been inactive for more than two years.
  • Member Violations

If you:

  • Breach these Terms, Additional Legal Terms, Policies, or our Standards.
  • Violate applicable laws, regulations, or third-party rights.
  • Repeatedly receive poor Reviews or if Big Nomads becomes aware of or receives complaints about your performance or conduct.
  • Repeatedly cancel confirmed Bookings or fail to respond to Booking requests without valid reason.
  • Engage in actions that are necessary to protect the personal safety or property of Big Nomads, its Members, or third parties:

Big Nomads may take the following actions:

  • Suspend or limit your access to or use of the Platform and/or your account.
  • Suspend or remove Listings, Reviews, or other Content.
  • Cancel pending or confirmed Bookings.
  • Suspend or revoke any special status associated with your account.

In non-material violations or where appropriate, you will be given notice and an opportunity to resolve the issue unless such notification would impede the detection or prevention of fraud or other illegal activities, harm the legitimate interests of other Members or third parties, or contravene applicable laws.

10.3 Legal Mandates

Big Nomads may take any action deemed reasonably necessary to comply with applicable law, court order, or governmental request, including the measures described above.

10..4 Effect of Termination

If you are a Host and terminate your account, all confirmed Bookings will be automatically canceled, and your Guests will receive a full refund. If you terminate as a Guest, any confirmed Bookings will be automatically canceled, and refunds will be subject to the Listing’s cancellation policy. Upon termination, you are not entitled to restoration of your account or any Content.

10.5 Appeal

If Big Nomads takes any of the measures described in this section, you may appeal such a decision by contacting our customer service. This ensures a fair and transparent process that respects the rights of all Users.

11 Modification

When Big Nomads proposes changes to these Terms, we will post the revised Terms on the Platform and update the “Last Updated” date at the top of these Terms. We will provide Users with notice of the proposed changes via email at least thirty (30) days before the date they become effective.

11.1 Material Changes

If the proposed changes to these Terms are material, affecting the essential provisions, including but not limited to provisions defining the nature and scope of the services provided by Big Nomads, you will be asked to explicitly accept the revised Terms. Such notice will inform you about:

  • Your Right to Reject: The notice will detail your right to reject the proposed changes and the specific timeframe to do so.
  • Your Right to Terminate: The notice will provide information about your right to terminate the Agreement at any time before the effective date of the proposed changes, as provided in these Terms.
  • Non-Material and Legally Required Changes

In the case of:

  • Non-material changes to these Terms that do not affect their essential provisions, including provisions defining the nature and scope of the services provided by Big Nomads.
  • Changes required by law, a legally binding court decision, or a binding order from a competent authority,

Your continued use of the Platform after the effective date of the proposed changes will constitute acceptance of the revised Terms.

11.2 Understanding Your Responsibilities

It is your responsibility to review the Terms regularly and be aware of any modifications. If you do not agree with the revised Terms, your sole remedy is to stop using the Platform and notify us of your termination of this Agreement in accordance with the “Termination” section.

11.3 Effect of Changes on Ongoing Transactions

Any changes to the Terms will not apply retroactively and will not alter the terms or conditions of any existing Booking, unless explicitly stated in the notice of modification.

12 Indemnification

12.1 Indemnification

To the maximum extent permitted by applicable law, you agree to release, defend (at Big Nomads’ option), indemnify, and hold Big Nomads (including affiliates and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your Breach of Terms: Any breach of these Terms, including any supplemental or additional terms that apply to a product or feature, or our Additional Legal Terms, Policies, or Standards.
  • Improper Use of the Platform: Any improper use of the Big Nomads Platform, including but not limited to fraudulent, malicious, or negligent actions.
  • Interactions with Users: Your interaction with any Host, Guest, or other User, including stays at a rental property, participation in any Big Nomads feature or service. This includes, without limitation, any injuries, losses, or damages (whether compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation, or use.
  • Failure Regarding Taxes: Your failure, or our failure at your direction, to accurately report, collect, or remit any applicable taxes, levies, or duties that may be required under applicable law.
  • Violation of Laws and Third Party Rights: Your breach of any laws, regulations, or third-party rights, such as intellectual property or privacy rights, including unauthorized use of copyrighted material, trademarks, or any other proprietary information without proper authorization.
  • False or Misleading Content: Any false or misleading Content provided by you that causes harm or damage to Big Nomads or any User.
  • Non-Compliance with Booking Agreement: Any failure to comply with the Booking agreement between you and another User, including failure to provide the property as described in the Listing or failure to pay amounts owed.

The indemnification obligation applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your culpable breach of a contractual obligation or negligent act or omission.

12.2 Indemnification Procedures

In the event of a claim, we will provide you with prompt written notice and the option to take control of the defense and settlement of the claim (at your expense). You shall cooperate with us in asserting any available defenses. Big Nomads reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

13 Limitation of Liability

13.1 Limitation of Liability

General Limitation: To the fullest extent permitted by applicable law, Big Nomads (including its affiliates, contractors, employees, agents, suppliers, licensors) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your Use or Inability to Use the Platform: Any access to or use of the Platform or any part thereof, or any failure, delay, or interruption of the same.
  • Any Unauthorized Access or Use: Any unauthorized access to or use of our servers, systems, or any personal or other information stored therein.
  • Any Interruption or Cessation of Services: Any interruption or cessation of transmission of the Platform or related services.
  • Events Beyond Big Nomads’ Control: Any unforeseen events that are beyond Big Nomads’ reasonable control, such as natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.

13.2 Booking Limitation

In connection with your Booking, Big Nomads shall not be liable for any harm, injury, loss, or damages that occur during your stay at a property rented through the Platform. While Big Nomads serves as a marketplace to facilitate Bookings between Guests and Hosts, it does not control or manage the properties listed on the Platform, and thus cannot be held responsible for any incidents that may occur during your Booking.

13.3 Reasonable Steps

Big Nomads endeavors to ensure the accuracy, reliability, and quality of the Platform and the Content. We will take reasonable steps to safeguard the Platform and ensure its proper functioning. However, we do not warrant that the Platform will be uninterrupted, error-free, or free from malicious code, and therefore shall not be liable for any damages or harm attributable to such issues.

13.4 Caps on Liability

Notwithstanding any of the above, our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Big Nomads for the Platform services in the twelve (12) months prior to the event giving rise to the liability.

13.5 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

13.6 User Responsibility

You acknowledge that Big Nomads is solely a platform connecting Guests and Hosts and that you are responsible for your actions, decisions, and compliance with all applicable laws and regulations.

14 Applicable Law and Jurisdiction

These Terms are governed by and construed in accordance with Canadian law. If you are using the Platform as a consumer, and if mandatory consumer protection regulations in your country provide more beneficial provisions, such rules shall apply. You may bring any legal proceedings related to these Terms in the competent courts of your place of residence or Big Nomads’ place of business in Canada.

15 No Waiver

Big Nomads’ failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless formally acknowledged and agreed to by us in writing. The exercise by either party of any remedies under these Terms shall be without prejudice to its other remedies under these Terms or otherwise permitted under applicable law.

16 Assignment

You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Big Nomads’ prior written consent. Big Nomads may, without restriction, assign, transfer, or delegate this agreement and any rights and obligations hereunder, at its sole discretion, with 30 days’ prior notice. Your right to terminate this agreement at any time as provided elsewhere in these Terms remains unaffected.

17 Notice

Unless specified otherwise, any notices or other communications to Users permitted or required under this agreement will be provided electronically and given by Big Nomads via email or through notifications on the Big Nomads Platform. It is your responsibility to keep your registered email address updated and to regularly check for notifications to ensure timely receipt of all communications.

18 Interpretation

18.1 Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

18.2 Entire Agreement

Except as they may be supplemented by additional terms, conditions, policies, guidelines, standards, and in-product disclosures, these Terms constitute the entire agreement between Big Nomads and you pertaining to your access to or use of the Big Nomads Platform. These Terms supersede any and all prior oral or written understandings or agreements between Big Nomads and you in relation to the Platform. These Terms do not and are not intended to confer any rights or remedies upon anyone other than you and Big Nomads.

19 Third-Party Services

19.1 Integration with Third Parties

The Big Nomads Platform may contain links to third-party websites, services, or resources, including payment processors, identity verification services, or other integrations (“Third-Party Services”). These Third-Party Services are not controlled by Big Nomads, and Big Nomads is not responsible for the content, products, services, or practices of these Third-Party Services. Links to Third-Party Services do not imply endorsement by Big Nomads.

19.2 Use at Your Own Risk

Access to or use of Third-Party Services is at your own risk, and Big Nomads shall not be responsible or liable for any damage or loss arising from your use of or reliance on Third-Party Services. You should review the terms and conditions, privacy policies, and other governing documents of any Third-Party Services you visit or utilize.

19.3 No Warranty

Big Nomads makes no warranties regarding the accuracy, completeness, timeliness, or reliability of any Third-Party Services. Your interactions and transactions with Third-Party Services, including payment and delivery of goods or services, are solely between you and the third parties. Big Nomads shall have no liability for any loss or damage incurred as a result of such interactions or transactions.

19.4 Data Sharing

By using the Platform, you may grant permission for Big Nomads to share certain information with Third-Party Services as required for the functionality of the Platform or to fulfill the Booking or Listing requirements. Big Nomads shall follow applicable privacy laws and regulations in sharing such information, and it will only be shared as necessary and with proper safeguards in place.

19.5 Indemnification
